The U.S. Department of State has released the January 2026 Visa Bulletin, and it delivers another round of encouraging news for EB-5 investors. Unreserved EB-5 categories for both China and India advance again, while all three EB-5 set-aside categories remain current worldwide.
Notably, this bulletin marks meaningful progress for pre-RIA Indian applicants, including the first movement in India’s Dates for Filing in years—opening the door for many investors already in the U.S. to finally move forward with adjustment of status.
USCIS has also confirmed that it will continue accepting employment-based adjustment of status filings in January, preserving important filing flexibility for EB-5 applicants inside the United States.
Understanding the Visa Bulletin
Each month, the Visa Bulletin determines green card availability based on country of chargeability and visa category. For EB-5 investors, two charts are critical:
Final Action Dates: When a green card can be approved
Dates for Filing: When applicants may submit Form I-485 (adjustment of status)
When a category is listed as “Current,” visas are immediately available with no backlog.

The January bulletin shows continued forward movement in the unreserved EB-5 category:
Unreserved EB-5
China: Advances one month to August 15, 2016
India: Advances nearly 10 months to May 1, 2022
All other countries: Remain Current
Reserved EB-5 (Rural, High Unemployment, Infrastructure)
All countries: Remain Current
This marks the second consecutive month of progress for unreserved EB-5 and reinforces the stability of the set-aside categories.
Forward Final Action Dates for Pending EB-2 and EB-3 (India):
EB-2 Final Action Date Movement:
Month/Month: Advanced 2 months (May 2013 to July 2013)
Trailing 12 Months: Advanced 9 months (October 2012 to July 2013)
EB-3 Final Action Date Movement:
Month/Month: Advanced 2 months (September 2013 to November 2013)
Trailing 12 Months: Advanced 11 Months (December 2012 to November 2013)

The most notable development this month appears in Dates for Filing:
Unreserved EB-5
China: Advances 31 days to August 22, 2016
India: Advances dramatically 761 days to May 1, 2024
This is the first movement in India’s EB-5 Dates for Filing since 2022, allowing many pre-RIA Indian investors currently in the U.S. to file adjustment of status applications in January, which now unlocking work authorization, travel permission, and long-term stability while their cases continue.
All reserved EB-5 categories remain current, with no cut-off dates announced and no warning signs of near-term retrogression.
Movement for Pending EB-2 and EB-3 (India):
EB-2 Dates for Filling
Month/Month: No change (December 2013)
Trailing 12 Months: Advanced 11 months (January 2013 to December 2013) Dates for Filing and Adjustment of Status
EB-3 Dates for Filling
Month/Month: No change (August 2014)
Trailing 12 Months: Advanced 14 Months (June 2013 to August 2014)

USCIS Confirms Dates for January Filings
USCIS has confirmed that Dates for Filing will remain in effect for employment-based adjustment filings in January 2026.
For eligible EB-5 investors inside the U.S., this means the ability to:
File I-485 and I-526E concurrently
Obtain Employment Authorization (EAD) and Advance Parole
Remain in the U.S. with increased flexibility during processing
Reserved EB-5 Categories: Stability Continues
All three EB-5 set-aside categories—Rural, High Unemployment, and Infrastructure—remain current with no warning of near-term retrogression in the January bulletin notes.
This continued consistency provides reassurance to new investors considering EB-5 in early 2026. While demand is growing, reserved visas continue to offer:
Immediate visa availability
Priority processing for rural projects
Strong insulation from legacy backlogs
EB-2 and EB-3: Why More Applicants Are Looking at EB-5
Outside of EB-5, the January bulletin shows only modest movement across EB-1, EB-2, and EB-3 categories, with long-standing backlogs continuing for high-demand countries like India and China.
For many professionals facing years or decades of waiting, EB-5 is increasingly viewed as a strategic alternative that offers:
A direct path to permanent residence
Independence from employer sponsorship
Predictable processing without annual quota uncertainty
Earlier access to work and travel authorization through concurrent filing
Why This Matters for EB-5 Investors
January’s bulletin reinforces several key trends:
Unreserved EB-5 backlogs for China and India are steadily improving
All EB-5 set-aside categories remain fully open worldwide
Rural projects continue to offer the fastest and most reliable EB-5 pathway
Indian investors gain a rare and valuable filing opportunity
For investors evaluating timing—especially those from backlogged countries—current conditions remain highly favorable.
Looking Ahead
January 2026 represents a turning point for many EB-5 investors, especially those who have been waiting years in the unreserved category. With forward movement, filing opportunities reopening, and set-aside visas still wide open, this is one of the strongest EB-5 landscapes we’ve seen in recent years.
For investors considering EB-5—or those reassessing long employment-based waits—now is a critical moment to evaluate next steps and secure a priority date while momentum is on your side.
Because your Green Card shouldn't take a Lifetime.
