The U.S. Department of State has released the December 2025 Visa Bulletin, and this month brings meaningful progress, especially for EB-5 investors from China and India. All three set-aside categories remain current worldwide, while EB-5 unreserved categories for China and India advance by several months.
USCIS has also confirmed that employment-based adjustment of status applications will continue to use the Dates for Filing chart in December, giving many EB-5 investors inside the U.S. the opportunity to file earlier.
Overall, December provides strong momentum and favorable conditions for new and existing EB-5 applicants.
What Is the Visa Bulletin?
The Visa Bulletin, published monthly by the Department of State, outlines green card availability across family- and employment-based immigration categories.
For EB-5 investors, two charts matter most:
Final Action Dates (FAD): When a green card can be approved.
Dates for Filing (DFF): When applicants may submit Form I-485 for adjustment of status.
A category listed as “Current (C)” means there is no visa backlog—all qualified applicants can proceed regardless of their priority date.

December brings the most positive movement in months for the unreserved category:
China: Advances over seven months, moving to July 15, 2016
India: Advances five months, moving to July 1, 2021
All other countries: Remain Current
All Rural, High-Unemployment, and Infrastructure set-aside categories remain Current worldwide, meaning no wait times for any country.
This consistency continues to make set-aside visas—especially Rural—the fastest pathway to a U.S. green card.
Dates For Filing

The Dates for Filing chart remains mostly stable:
The only change is a small advance for EB-5 China (unreserved), which moves forward three weeks to July 22, 2016.
All set-aside categories remain Current.
USCIS has confirmed that applicants may use this chart for adjustment of status filings in December, giving many EB-5 investors inside the U.S. the chance to file their I-485s even if their Final Action Date is not yet current.
This allows eligible investors to:
File I-485 and I-526E concurrently
Receive Work Authorization (EAD) and Advance Parole (AP)
Remain in the U.S. with greater flexibility throughout processing
EB-2 and EB-3 Movement: Why Many Applicants Are Re-Evaluating Their Options
In addition to the favorable EB-5 updates, the December 2025 Visa Bulletin shows continued challenges for many professionals filing under EB-2 and EB-3. While there is modest forward movement in some categories, both EB-2 and EB-3 remain heavily retrogressed for high-demand countries, particularly China and India.
For many people waiting in these queues, especially those with priority dates years away from becoming current, EB-5 is increasingly viewed as a more reliable and significantly faster path to permanent residency.
Key reasons EB-2/EB-3 filers are considering EB-5:
Long and unpredictable wait times continue for EB-2/EB-3 applicants from China and India.
Employment-based categories remain vulnerable to annual visa caps, demand surges, and retrogression.
EB-5 set-aside categories are all Current, offering immediate visa availability and faster approval timelines.
Concurrent filing under EB-5 allows eligible applicants in the U.S. to obtain EAD/Advance Parole while waiting, which is not available for many stuck in EB-2/EB-3 backlogs.
For professionals who have been waiting years in EB-2 or EB-3—or those concerned about worsening retrogression—EB-5 provides a strategic alternative that offers greater certainty, stability, and a direct route to a green card.

What This Means for EB-5 Investors
The December Bulletin reinforces several promising trends for the EB-5 program:
Unreserved cutoff dates move forward meaningfully for China and India, reducing wait times.
All set-aside categories remain open worldwide, with no sign of backlog.
Rural projects continue to receive priority processing under the Reform and Integrity Act of 2022.
Investors already in the U.S. can benefit from USCIS’s decision to use the Dates for Filing chart, enabling concurrent filing.
For new investors—especially from backlogged countries like China and India—the set-aside programs offer the clearest and quickest path to a U.S. green card.
Why December Is an Excellent Time to Begin Your EB-5 Process
A combination of program advantages makes now an ideal time:
Set-aside categories remain fully current for every country.
Priority processing continues for rural investments.
Concurrent filing provides early work and travel authorization for eligible clients.
A recent court ruling has temporarily restored the pre-2024 I-526E filing fee ($3,675 + $1,000 Integrity Fund fee), lowering upfront costs.
Demand for EB-5 remains strong, and future visa cutoffs are possible as usage grows.
Starting your application now helps secure your priority date early while conditions are highly favorable.
Because your Green Card shouldn't take a Lifetime.
