The U.S. Department of State has released the November 2025 Visa Bulletin, bringing continued stability across all employment-based categories, including EB-5. All set-aside visa categories remain current for every country, while unreserved visas for China and India stay at the same cutoff dates as October.
For EB-5 investors, this means continued opportunity and an ideal moment to move forward while all set-aside categories remain open.
What Is the Visa Bulletin?
Each month, the Visa Bulletin, issued by the U.S. Department of State, provides a snapshot of immigrant visa availability under U.S. law. It determines when applicants in employment-based and family-based categories can file for adjustment of status (Form I-485) or receive final green card approval.
Two charts are especially important for EB-5 investors:
● Final Action Dates: when the U.S. government may approve a green card application.
● Dates for Filing: when applicants may submit their adjustment of status applications to USCIS.
A category listed as “Current (C)” means visas are available for all qualified applicants.
If a cutoff date is listed, only those with a priority date earlier than that cutoff may proceed.
Final Action Date Movement

There are no changes in cutoff dates from October. The employment-based categories remain stable, with no forward movement or retrogression.
All set-aside categories remain current for every country, confirming that new investors still benefit from open visa availability. For investors from backlogged countries (especially India and China) the ability to invest under a set-aside category remains one of the most strategic ways to avoid visa waiting lines.
Dates for Filing

USCIS has confirmed it will continue to accept employment-based adjustment filings under the Dates for Filing chart for November. All dates remain unchanged from October. This decision allows eligible investors extra time to prepare and submit their adjustment of status applications.
Since these dates remain unchanged, EB-5 investors already in the U.S. on nonimmigrant visas (F-1, H-1B, L-1, J-1, etc..) can continue to file their Form I-485 adjustment of status applications concurrently with their I-526E petitions if investing in a current set-aside project.
This concurrent filing option offers major benefits:
● Early work (EAD) and travel (Advance Parole) authorization for investors and their families
● Greater flexibility to stay in the U.S. while waiting for approval
● A smoother transition toward permanent residency
What This Means for EB-5 Investors
The November Bulletin reinforces several key trends:
● All EB-5 set-aside categories remain open, including rural, high-unemployment, and infrastructure projects.
● Rural petitions continue to receive priority processing under the EB-5 Reform and Integrity Act (RIA).
● China and India remain backlogged in the unreserved category, but new investors can bypass these delays by choosing set-aside projects.
As USCIS continues to adjudicate rural cases faster, interest in these categories is expected to rise, potentially leading to future retrogression as demand grows.

Why Filing Early Still Matters
Even though all set-aside categories are current, this window of opportunity may not last. Early filing helps investors:
● Lock in their priority date, securing a place in line in case of future backlogs.
● File concurrently (Forms I-526E and I-485) if already in the U.S., gaining work and travel authorization sooner.
● Avoid potential processing slowdowns as USCIS receives more EB-5 petitions.
Filing now helps ensure your case stays ahead of any upcoming changes or visa retrogressions.
