1. Job Creation: The Core of EB-5 Eligibility

At the heart of every EB-5 project is the requirement to create at least 10 full-time jobs per investor. But not all job creation models are created equal.

The most secure projects are structured using third-party economic methodologies (such as RIMS II or IMPLAN) and have buffered job creation, meaning they generate significantly more jobs than the minimum required.

Ask:

  • How many jobs are projected per investor?

  • Is the job count based on construction, operations, or a mix?

  • Is there a third-party economist report verifying this?

How is the project being financed—and what percentage of total funding comes from EB-5?

  • The method of repayment (e.g., refinance, Cash flow, sale of asset)

5. Compliance with the EB-5 Reform and Integrity Act (RIA)

The 2022 EB-5 Reform and Integrity Act brought long-overdue reforms to the industry—especially in transparency, fund tracking, and project oversight.

Today, all quality projects should:

  • Be sponsored by a USCIS-approved regional center

  • Have a filed I-956F with project-specific approval

  • Follow annual fund audits and third-party administration

  • Provide clear and accessible updates to investors

If your project isn’t fully RIA-compliant, it’s a red flag.


6. Set-Aside Eligibility: Rural, HUA, or Infrastructure

In today’s crowded market, projects that qualify for set-aside visas (Rural, High-Unemployment Area, Infrastructure) are often prioritized on the Visa Bulletin and offer faster green card timelines.

In 2025, Rural projects are seeing the strongest demand, with over 4,000 petitions already filed for just 2,000 annual visas—so acting early matters.

Before choosing a project, ask:

  • Does it qualify for a set-aside category?

  • Is the category current or backlogged?

  • What’s the risk of regression?
