Trump’s $5 Million Gold Card vs. EB-5: What Investors Need to Know

ree

At EB-5 USA, we believe in direct, data-driven insights for our partners and investors, and today, we have the pleasure of sharing more information on the Trump Gold Card.  The Washington Post recently reported, “Trump’s $5 million ‘gold card’ visa might never happen”.  While the previous few months’ media headlines have captured this simple method of “pay for play” in obtaining a green card, that might just be all it is…a headline. The article examines the actual movement of the proposal, hammering the point, there have been no steps towards implementation—None.  For a program like this to take off the ground, serious legislative action will need to be taken, coupled with expending political capital.  But what does this proposal actually mean for EB-5 investors and immigration attorneys advising clients today?

What Is the Gold Card Proposal?

In February 2025, the Trump administration began promoting a new $5 million “Gold Card” investor visa aimed at wealthy foreigners seeking fast-track U.S. residency. The rollout included a website, a waiting list, and even a golden laminated prototype shown aboard Air Force One.

However, as reported by The Washington Post, legal experts note that creating a brand-new visa category requires Congressional approval. Immigration law has not added a new visa category in over three decades, and recent hearings showed minimal appetite in Congress to advance such a program.

Why Is This Important for EB-5 Stakeholders?

Because while the Gold Card garners media attention, the EB-5 program remains the only legislatively approved immigrant investor pathway in the United States today. It is codified under the Reform and Integrity Act (RIA) through 2027 and backed by decades of legal precedent, economic impact studies, and structured investor protections.

Recent data reinforces this stability (IIUSA):

  • Between 2016-2019 alone, EB-5 investments generated over $184 billion in GDP contributions, created 1.7 million jobs, and paid out $122 billion in wages to U.S. workers.

  • The average EB-5 project yields 45 jobs per investor, exceeding the program’s 10-job minimum by nearly 4x.

Why Is the Gold Card Facing Pushback?

According to top immigration attorneys and former DHS officials cited in The Washington Post:

  • No lawful basis exists for the executive branch to unilaterally create a new visa category without legislation.

  • Congress has been historically resistant to creating new green card pathways, especially in the current political environment.

  • Legal challenges would be immediate if the administration attempted to implement this program without statutory support.

For clients, this means that while the Gold Card may seem like an enticing fast-track, its actual feasibility remains highly uncertain.

The Strategic Takeaway for Investors

In an environment where H-1B layoffs are rising and immigration policy remains volatile, EB-5 continues to offer:

  • Concurrent filing for Adjustment of Status, giving H-1B holders freedom from employer sponsorship risks.

  • Set-aside categories (Rural & HUA) with reduced investment minimums and priority processing.

  • Economic credibility backed by third-party job creation studies, unlike untested proposals such as the Gold Card.
